In consideration of the provision of dog walking and dog sitting services provided by Dawg Tired Inc. and their employees, agents or contractors as more particularly described on the website dawgtired.ca (the “Services”), I, for myself and my family members, heirs, executors, representatives and administrators (the “Releasors”), hereby agree to release and discharge Dawg Tired Inc. and its employees, agents, contractors, volunteers, shareholders, directors and affiliated companies (the “Releasees”) from any and all liability, claims, demands, actions, or rights of actions which are related to, arise out of, or are in any way connected to the provision of the Services including in respect of any and all injury, illness, disease, death and other damage and loss to myself or to other persons, animals or to property. In the event of any injury, illness, disease, death and other damage and loss to myself, to others persons or animals or to property, I agree that I shall be liable for any and all costs and expenses that I may be required to incur or expend in connection therewith, including but not limited to medical and veterinarian costs. In addition, I agree that I shall remain solely liable and responsible, and shall indemnify and save harmless Dawg Tried Inc. and the each of the Releasees, for any harm, damage or injury caused by my dog(s) to any persons (including myself or third parties), property or animals.
I give permission for Dawg Tired to use a photograph/video of my dog(s) for their web page, social media and/or marketing material including my testimonials and comments as it pertains to Dawg Tired Inc.
I acknowledge that the provision of the Services and my participation and retention of the Services entails known and unknown risks that could result in injury, illness, disease, death and other damage and loss to myself, to others persons or animals or to property. I understand that the provision of the Services may expose me, my dog, my property and other third parties to various risks which include, but are not limited to, the hazards of walking/running on variations in terrain; steepness of slopes; slips and fall; the forces of nature, including lightning, rain, snow, ice, sleet, bare spots and changing weather conditions; falling off a rock, mountain, or any obstacle; the risks of exposure to insect bites, animal bites, frostbite, hypothermia, sunburn; normal city hazards, including traffic; and the possibility of encountering wildlife both in and out of the city.
I agree that I am responsible for my own safety, as well as the safety of my family members, including my dog(s), and I agree to assume and accept all the risks and dangers that are associated with the provision of the Services and my participation in them. The retention and hiring of Dawg Tried Inc. for the provision of the Services is purely voluntary despite the foregoing risks and, at any point, I may elect to cease participating in the Services, and dismiss or terminate Dawg Tried Inc. from providing the Services.
I agree to supply Dawg Tired Inc. with keys and/or alarm codes to enter my premises with the express purpose of picking up and dropping off my dog(s) in order to provide the Services. I understand that my keys will be returned to me within 48 hours of my written dismissal or termination of Dawg Tired Inc.’s services. I understand that should Dawg Tired Inc. lose a key(s) or otherwise cause damage to my security alarm or ancillary damage to my premises as a result thereof that they will indemnify me for the cost or expense incurred to replace the key(s) or remedy the damage up to a maximum cost of $400.00.
This Liability Release and all aspect thereof specifically includes and applies to what may be considered to be inferred, or deemed acts or omissions of the Corporation, including negligence, breach of contract, or breach of any statutory or other duty of care, on the part of any of the Releasees but excludes acts of gross negligence or willful misconduct on the part of any of the Releasees.
Additional Terms and Conditions Respecting the Provision of Services
I accept that disrupting, rude, disrespectful and/or slanderous behavior from me, my family members, my dog(s) or my acquaintances will not be tolerated. Dawg Tired Inc. reserves the right to suspend the provision of Services indefinitely for such reasons. I will inform and disclose to Dawg Tired Inc. any physical health issues which might compromise my dog’s ability to participate in moderate physical activity. I acknowledge that it is my responsibility to provide the required training equipment as may be required and requested by Dawg Tired Inc., and incur 100% of the cost of a properly fitted martingale collar and training leads as required. I understand that Dawg Tired Inc. has the right to refuse to provide the Services without such proper equipment. Dawg Tired Inc. reserves the right to require a muzzle for my dog at my expense. I agree to ensure all my dog(s) vaccinations are up to date, including Parvo, Distemper and Bordetella, or have satisfactory titer tests in place of vaccinations, or a note directly from the veterinarian.
I understand that the Services should not be mistaken for the provision dog training services. I agree that my dog(s) has or will receive any training deemed necessary to participate in any the Services. Any advice or suggestions on training, healthcare and the well being of my dog(s) offered by Dog Tired Inc. or any of its employees, agents, contractors or volunteers should never take place over that of my veterinarian.\r\nI understand that Dawg Tired reserves the right to cancel walks at anytime, including but not limited to holidays, thunder-lightning storms and temperature below -20 degrees (celcius), without offering a make-up walk. I understand that I must give Dawg Tired Inc. a minimum of 24 hours notification for cancellation of walks, otherwise I will be charged full price for that walk. I understand that for dog sitting services a 25% deposit will apply during peak periods. Peak periods include: June through August, Christmas, Spring Break, and all statutory holiday long weekends. The aforementioned 25% deposit shall become non-refundable if cancellation notice is not given 30 days prior to a previously agreed drop off date for dog sitting services.
Acknowledgment
I have carefully read, understood and accepted the terms and conditions stated herein and acknowledge that this Liability Release shall be effective and binding upon myself and all Releasors. I understand that this is a release of liability which will legally prevent me or the persons described herein from filing suit or making any other legal claim for damages as more particularly described herein. I am executing this Liability Release freely and voluntarily.
THIS IS A LIABILITY RELEASE – PLEASE READ CAREFULLY BEFORE INITIALING. THIS LIAIBLITY RELEASE MUST BE READ, UNDERSTOOD AND INITIALED PRIOR TO PROVISION OF SERVICES BY DAWG TIRED INC..
